How could we know/assure that?
Nor even the chinese sellers know that.
They just resell anything...
I recently received "new" TDA8920BTH from China; got them with 20 pins, instead of 24 pins as normal.
These chinese don't have any idea about electronics.
They also get scammed I suppose, just because of missing knowledge...

I have ordered FDMF6808N probably 10 times, in quantities of 5 to 100 pieces. Of the 10 orders, ~7 times they were not new; the only times they were new were with the 3 smallest orders (5, 10 and 10 pieces). Such a pain returning them to China. Best bet is to place 3-5 orders from 3-5 sellers, low quantities (minimum quantity), and hope that 1 or 2 orders are actually new.
Try ones from a scrap board.
But you know, these can be "tired" too.
Check at least that are not shorted...
